In August, creditors of the banks put into liquidation received UAH 554.8 million

In August 2023, the banks put into liquidation and managed by the Deposit Guarantee Fund (hereinafter – the DGF) settled their creditors’ claims in the amount of UAH 554.8 million. Almost UAH 77.8 million was allocated to settle the third priority claims (the DGF’s claims arising in cases specified by the Law of Ukraine on the Household Deposit Guarantee Scheme); UAH 4.8 million was directed to settle the fourth priority claims (claims of individuals exceeding the guaranteed amount); UAH 472.2 million was applied to pay out the seventh priority claims (legal entities not related to the banks in question), inclusive of UAH 443.4 million allocated to the priority settlement of secured creditors’ claims (namely, the NBU). Creditors of the second, sixth and eighth tiers received the rest of the funds.

In January-August 2023, the amount of satisfied creditors’ claims totaled UAH 5,342.9 million, of which UAH 601.5 million was directed to the priority settlement of claims of the secured creditors.

In general, as of September 1, 2023, UAH 65,196.7 million was paid to the creditors of the insolvent banks, of which UAH 17,628.4 million – to the secured creditors inclusive of UAH 16,262.6 million directed to the NBU (including due to foreclosure on encumbrance items and property of the guarantors).

It is to be recalled that the funds received from the liquidation and sale of property (assets) of the insolvent banks are channeled by the DGF to satisfy the claims of these banks’ creditors. Given the low quality of assets, the market value of which is much lower than the nominal one, many creditors’ claims remain unsatisfied due to insufficient assets of such banks. In this regard, the DGF takes the necessary measures to implement the provisions of Article 52 of the Law of Ukraine on the Household Deposit Guarantee System and to bring the related parties (owners and management of banks), whose actions and decisions caused losses to the insolvent banks, to responsibility. All funds recovered by the DGF from these activities are directed to the banks’ creditors.

As of September 1, 2023, in accordance with Article 52 of the Law of Ukraine on the Household Deposit Guarantee Scheme, 81 lawsuits were filed by the DGF against 52 banks. The total number of defendants related to these banks is 960. The total amount of the stated claims is UAH 158,740.0 million. The total amount of the DGF claims satisfied by court decisions that have entered into force equals more than UAH 1,953 million.

In addition, the DGF has filed 35 civil suits within pending criminal proceedings against 22 banks. The total number of civil defendants is 68 persons. The total amount of claims is UAH 24,644.1 million.

At the same time, according to the results of the criminal proceedings and based on the court decisions as of September 1, 2023, the DGF initiated 6 lawsuits against 6 banks to recover the damages caused by criminal offenses. The total number of defendants is 6 persons. The total amount of the stated claims is UAH 5,175.5 million. The total amount of the DGF claims, satisfied according to the court decisions that have entered into force, exceeds UAH 2,537 million.
