Pre-qualified persons have the opportunity to review information about the bank by concluding a non-disclosure agreement with the DGF.
After the bank is declared insolvent by the NBU, the DGF introduces a temporary administration, announces a tender and sends invitations to all potential bidders to participate in the resolution. After that, Ukrainian banks and pre-qualified persons can conduct a due diligence of the bank, evaluate its assets and prepare bids. The DGF organizes a physical (on the bank's premises) and a virtual data room for them.
Before providing information, the DGF checks interested parties to ensure that they are not affiliated with an insolvent bank and that they meet other tender conditions. The procedure for accessing information on the bank is set out in the terms of the tender. All potential bidders in an open tender that conducts due diligence have equal access to the insolvent institution's information.
According to the law, pre-qualified persons have the right to review the data in the virtual data room in advance - during the DGF's preparation for the bank's resolution procedure.
